Explanatory Memorandum to the
Plant Health (Fees) (Wales) Regulations 2014
This Explanatory Memorandum has been prepared by the Natural Environment & Agriculture Team within the Natural Resources and Food Department and is laid before the National Assembly for Wales in conjunction with the above subordinate legislation and in accordance with Standing Order 27.1

The purpose of this instrument is to revoke and replace the Plant Health (Fees) (Wales) Regulations 2013 (S.I. 2013 No. 1700 (W. 164)) (“the 2013 Regulations”), which outlines the fees to be charged for plant health services provided by the Food and Environment Research Agency (Fera) on behalf of the Welsh Ministers. This instrument provides for average decreases and increases in, and the continuation of, the fees specified in the 2013 Regulations.
There are no matters of special interest to the Constitutional and Legislative Affairs Committee.
This instrument is made in exercise of powers conferred by section 56(1) and (2) of the Finance Act 1973, which are now vested in the Welsh Ministers by virtue of section 59(5) of the Government of Wales Act 2006. These powers permit the Welsh Ministers to make regulations which require the payment of fees or other charges for the provision of any services or facilities or the issue of any authorisation, certificate or other document, in pursuance of any EU obligation. As such, this instrument requires Treasury consent which has been granted.
This instrument will follow the negative resolution procedure.
Council Directive 2000/29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community[1] (“the Plant Health Directive”) establishes the EU plant health regime.
The Plant Health Directive is implemented in Wales, for non-forestry matters, by the Plant Health (Wales) Order 2006 (S.I. 2006 No 1643 (W.158)). Similar but separate legislation operates in England, Scotland and Northern Ireland. For forestry matters the Plant Health Directive has been implemented by the Plant Health (Forestry) Order 2005 (S.I. 2005 No 2517), which applies throughout Great Britain.
The Plant Health Directive has been amended amongst other amendments by Council Directive 2002/89/EC of 28 November 2002[2]. Among the changes introduced by this Directive was clarification of the existing requirement for mandatory examinations (documentary checks, identity checks and physical inspection) on certain plants and plant produce and obligations to charge for these inspections. The Plant Health Directive makes provision for reducing the rate of inspections of certain plant imports (Article 13a (2)) and for charging a correspondingly reduced fee for inspections (Article 13d (2)).
In line with the principle that the costs of statutory services should be borne by users who benefit directly from a service, charges also apply for the following activities required by the Plant Health Directive:
The reason for making this instrument is to provide for increases in fees payable in relation to plant health, as part of a phased move towards full cost recovery of such fees and to implement changes to import inspection fees in connection with the annual adjustment to plant health inspection levels of fruit and flowers imported from third countries, under the EU’s risk targeted inspections provisions.
Increases in plant health services fees are part of a phased move towards full cost recovery
Fera is responsible in Wales, on behalf of the Welsh Ministers, for provision of plant health statutory services to facilitate trade and prevent the introduction and spread of plant pests and diseases.
Charging for these services is consistent with the principle that businesses using the service should bear the cost of any measures to prevent harm that they might otherwise cause by their actions or non-actions, since most serious pests and diseases that arrive in this country do so via commercial trade in plants and plant produce.
Before the 2012 Regulations came into force, fees for five plant health services (plant health import inspections, seed potato certification, plant health licences, plant passports and inspection of potatoes originating from Egypt) hadn’t increased for many years resulting in income received from business users being less than 35% of the cost of the service provision. Following a public consultation in 2011, a phased increase in fees was implemented in 2012 with the intention of achieving full cost recovery for these services by 2014. The 2012 Regulations introduced the first step in that move towards full cost recovery, closing 50% of the gap between statutory income and the full cost of service provision. The second phase, closing a further 25% of the gap, was implemented through the 2013 Regulations. The third and final phase, closing the remaining 25% of the gap, will be implemented through this instrument, scheduled to come into force on 2 August 2014.
They provide for average increases on the fees specified in the 2013 Regulations as follows:
· import inspection fees documentary and identity checks by 24.5%;
· licensing fees by 2.2 %;
· fees for plant passporting services by 21.2%; and
They also provide for decreases by 3.5% on the fees specified in the 2013 Regulations for import inspections (other than documentary & identity checks).
Fees for services under the Seed Potato Classification Scheme and for inspection and testing of Egyptian potatoes remain unchanged.

Other changes introduced by the 2014 Regulations
In addition to changing the existing fees, this instrument also introduces fees for the issue of licences and testing of Lebanese potatoes. Commission Implementing Decision 2013/413/EU dated 30 July 2013 allows Member States to authorise the import of ware potatoes from certain regions of Lebanon, subject to post-import testing to ensure freedom from potato ring rot. Imports into Wales will be controlled through the issue of licences specifying notification, labelling, waste disposal etc. conditions. No mechanism currently exists to charge for the issue of such licences or for the post-import testing required.
This instrument also includes a new provision to allow for plant trader registrations to be suspended for unpaid fees as well as allowing the Welsh Ministers to recover any fees as a civil debt. Current sanctions for non-payment of fees are proving inadequate and require tightening. The instrument makes payment of fees a condition for maintaining registration as a plant trader (a requirement under the Plant Health (Wales) Order 2006 for anyone trading in plant material).
This instrument also clarifies how import inspections on mixed consignments are charged. (i.e. consignments comprising different types of material, some of which are eligible for reduced levels of inspection and some not.)
A consultation on proposals to revise fees for five plant health services ran from 11 October to 5 December 2011. The majority of respondents opposed any increase in fees but, in the event of any increase, preferred a phased increase to achieve full cost recovery over three years.

A consultation was not conducted for introducing fees in relation to potatoes originating in Lebanon.
6. Regulatory Impact Assessment (RIA)
No impact on charities or voluntary bodies is foreseen.
No impact on the public sector is foreseen.

Fera, who are an executive agency of Defra, is responsible in Wales, on behalf of the Welsh Ministers, for provision of plant health statutory services to facilitate trade and prevent the introduction and spread of plant pests and diseases. Costs, therefore, are collated on an England and Wales basis and are not available in a disaggregate format.
Fees in relation to potatoes originating in Lebanon
Having considered The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments and the likely negligible impact on business, the Chief Economist has advised that regarding the fees being introduced in relation to potatoes originating in Lebanon, it would not be proportionate to conduct an RIA. This is due to the likely costs and benefits of complying with the regulations and as there will be little or no expected impact from the change.
